Privacy Policy of PayLift Version 1.1 dated 26. February 2025

§1 Glossary of Terms

1.1 The terms used in this Privacy Policy mean:

  • Administrator - The controller of personal data in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA), which is PAYLIFT FINANCE LTD.
  • Data Processor - PAYLIFT FINANCE LTD.
  • PAYLIFT FINANCE LTD.formerly known as FASTWIRECO LIMITED, with its registered office at 1504-329 Howe Street, Vancouver, British Columbia, Canada, V6C 3N2, is regulated by the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC) as a Money Service Business, Company No. BC1500402, License No. C100000297.
  • Personal Data - Users' personal data, as defined by PIPEDA, provided in connection with the use of the Service.
  • Processing of Personal Data - All operations performed on personal data under the meaning of PIPEDA.
  • PIPEDA - The Personal Information Protection and Electronic Documents Act, SC 2000, c. 5 (Canada), and any amendments or regulations related to it.
  • Services - Services provided by PAYLIFT FINANCE LTD., which are electronic and consist of facilitating the purchase or sale of cryptocurrencies.
  • Website - The website accessible through the domain paylift.ca and its subdomains.
  • User - A natural or legal person who has accepted the Terms of Service and entered into an agreement with PAYLIFT FINANCE LTD. for the provision of the Services.

§2 General Provisions

2.1 The Service performs functions of obtaining information about Users and their behavior through:

  • Entering data into forms by Users;
  • Saving data in end-user devices in cookie files (commonly referred to as "cookies");
  • Collecting web server logs and other information generated automatically in connection with or as a result of the operation and use of the Service.

§3 Data Collection Principles

3.1 The use of the Services requires Users to provide Personal Data, as failure to provide all requested Personal Data may result in the inability to provide the Services.

3.2 The Website collects information provided directly by the User.

3.3 Data obtained from Users will not be made available to third parties unless:

  • The user consents to this,
  • It is required by law – including at the request of authorized authorities applying applicable laws,
  • It is necessary for the provision of the Services, such as technical services, payment processing, or cooperation with other entities engaged in the provision of the Service.

3.4 Personal Data will be processed for the duration of the Agreement for the provision of the Service.

§4 Scope of Personal Data and Their Processing

4.1 The Administrator may request the User to provide Personal Data.

4.2 The Administrator performs verification by requiring the User to provide an SMS code.

4.3 Personal data will be processed in accordance with PIPEDA.

4.4 The basis for data processing is the User's consent and legal provisions authorizing the processing of personal data.

4.5 Personal data will not be made available to other entities without the User’s knowledge, except for entities authorized under applicable law.

4.6 The User has the right to view, modify, and delete their personal data, unless such actions would violate applicable laws.

4.7 The Administrator may refuse to exercise the rights in points 5 and 6 if:

  • This results from applicable legal provisions,
  • This information is subject to ongoing investigations or proceedings,
  • It is necessary to clarify circumstances of the User’s violation of the Terms of Service.

§5 User and Their Rights

5.1 The User has the right to access and correct their Personal Data.

5.2 The User is entitled to request:

  • Additions,
  • Updates,
  • Rectification of Personal Data,
  • Temporarily or permanently suspend their processing or delete them if they are incomplete, outdated, inaccurate, have been collected in violation of the law, or are no longer necessary for the purpose for which they were collected.

5.3 The User may seek clarification from the Administrator and has the right to submit an inquiry, objection, or complaint to the relevant supervisory authority if the provisions of this Privacy Policy are unclear.

5.4 No automated decisions will be made based on the Personal Data processed. The data will not be used for profiling.

§5 User and Their Rights

§6 Detailed Information About Cookies

6.1 The website uses cookies.

6.2 Cookies are used for the following purposes:

  • Creating statistics to understand how Users interact with the Website, which enables improvements to its structure and content;
  • Maintaining the User’s session;
  • Determining the User’s profile to display tailored content in advertising networks, particularly the Google network.

6.3 The entity placing cookies on the User’s device and obtaining access to them is PAYLIFT FINANCE LTD.

6.4 Limiting the use of cookies may affect some functionalities available on the Website.

6.5 Cookies placed on the User’s device may also be used by:

  • Entities cooperating with PAYLIFT FINANCE LTD.,
  • Advertising networks, particularly Google, to display ads based on how the User uses the Website.

6.7 If the User does not wish to receive cookies, they can adjust their browser settings.

§7 Server Layer - User Information

7.1 Information about Users' activities is logged at the server level. This data is used primarily for Service administration and may be used for evidentiary purposes related to criminal offenses or civil claims.

7.2 The following data may be recorded:

  • Time of the query's arrival and response time,
  • Information about errors during HTTP/HTTPS transactions,
  • The URL address of the previously visited page (referrer link),
  • Information about the User's browser,
  • IP address information.

7.3 This data may be linked to specific Users.

§8 Entity Processing Personal Data

8.1 The Administrator confirms that the provider of the IT system on which data referred to in §7 and operation history are stored is PAYLIFT FINANCE LTD.

8.2 The Processor agrees to process the personal data entrusted to it in accordance with this Privacy Policy and other applicable legal provisions that protect the rights of data subjects.

8.3 The Processor has declared that it applies technical and organizational security measures to ensure the security of the processed personal data and respects the rights of data subjects.
